The committee shall issue a Certificate of Privilege to the shipper in the name of the State of Florida upon a majority vote of the committee members. If a company is selling and marketing a product that is not certified as organic or not sold through a third party, such company shall be prohibited from selling to a third party unless the third party certifies to the State that the product is Certified as Organic. This requirement in the Florida Statues must be followed. If a company is a new Florida citrus company, and the company is offering for sale citrus in an alternative form of packaging, such company must be certified to the state of Florida that it is offering to sell to a particular consumer as alternative packaging (organic). As the seller of alternative packaging the company shall obtain a Certificate of Privilege that allows the company to sell the alternative packaging to any person or business with the consumer's express written permission. For the purposes of this section it is a violation of the law for a person who does not engage in the business of selling citrus in alternate packaging or selling the product outside of Florida and a third party to engage in such activity. Such third party can be a business based in Florida, out-of-state, or outside of Florida in which such persons do not hold or engage in a Florida business enterprise. A Certificate of Privilege cannot and shall not be transferred or assigned. A person who is not in compliance with the requirements in this section and the Citrus Administrative Committee will be held in contempt of law. Citrus Administrative Committee Organic Shipment Rule (2) A shipment of certified non-citrus crops or products must meet the requirements in Chapter 504.22 through 504.35 of the Florida Statues, including the Florida Department of Agriculture and Consumer Services certified organic certification rules and the Florida copy. The Department shall provide a list of companies that, if certified, may make the certifications the Department recommends. There are no restrictions on certifying ancillary products to the products or crops and to being processed as a separate item, or packaged, for sale. This list would be available, at the sole discretion of the company owner or a representative. Citrus Administrative Committee Organic Shipment Rule (3) A shipper must provide a copy of the Certifying Officer's Certificate when a permit is requested at the time of shipment.
