PART A--RULES FOR THE PROCESSING OF ROTH CONTRIBUTIONS FOR CASH OR DEFERRED ARRANGEMENTS Under a 401(k)(3) plan or 401(k) plan and a 403(b)(3) plan or 403(b)(8) plan, the following rules apply to the processing and filing of a Roth contribution or a Roth elective deferral. As provided in this Part A, when an employer provides notice of an election to include a deferred amount in gross income (Section 6201), this notice is given retroactive to the date before the election takes effect unless it is revoked or cancelled before then (also Section 6201). All amounts included in gross income from contributions to a 401(k)(3) plan or 401(k) plan (for nonqualified withdrawals under Section 402(g) or to pay taxes under Section 3121) or a 403(b)(3) plan or 403(b)(8) plan for a period beginning before the date that the notice is given are converted to a fixed dollar amount when the employee actually disposes of the assets in a manner such that the amount, expressed in today's dollars, would be included in the gross income of the employee for the calendar year in which the contributions are received. Roth's contributions are treated as taxable wages. The amount from a section 401(k)(3) plan or a 401(k) plan which is included in a participant's gross income for a qualified year is taxable to the participant under the same instructions as were provided in the rules for the payment of wages to a participant with respect to contributions to or under the 401(k)(3) plan or 401(k) plan.
