§2045.05 Qualified disability trusts.
(a) Qualified disability trust. (1) Form W-2. The income tax return for the month preceding the month in which the trust was established, in which the taxable year of the trust begins, or the taxable year of the trust ends, whichever is later, must include the amount of wages received by the beneficiary from the trust during that calendar year. If the beneficiary has qualified under a qualified disability trust for an earlier taxable year, then the income of the beneficiary for the earlier taxable year includes the net amount of the trust's distributive share of the beneficiary's qualified disability benefits.
For purposes of this paragraph (a), the term qualified disability trust means any entity that is an employee welfare benefit plan (as defined in section 3(9) of title I of the Employee Retirement Income Security Act of 1974 (29 U.S.C. 1002) as in effect on the day before the trust became a qualified disability trust) or is not such a plan and meets the requirements of this subpart.
