In the immediate aftermath of our decision to terminate, the Commission was in the process of transitioning to a new office structure and the transition process is ongoing. However, during July, we had the opportunity to meet with several representatives of the Federal Government to discuss our concerns, including concerns regarding the adequacy and timeliness of reporting and processing fee payments, and the quality and cost of services provided by the Commission. In response to our meeting with the Government officials, we were provided with specific proposals that will support the Commission in the transition. The Federal Government proposal and our discussions with them will ensure that all payments made by the Commission to the non-profit guaranty agency will be issued within the time allowed during the transitional process. The proposals also will ensure that the Commission will have the time to adequately transition the operations of the program to the new office structure as it plans to do. The Commission will remain a non-profit auxiliary organization, continuing to operate on its revenue from fee payments under the previous agreement with the FED. The Federal Government proposal includes a number of provisions which will ensure the continued operations and accountability of the Commission. The Commission will submit a report (to be submitted on September 30, 2010) which will include any adjustments to the Federal Government's offer and to be submitted by September 30, 2010, a proposal to replace or reallocate the fees. The Bureau of Higher Education, as a new entity, will operate under the administrative authority of the Division of Student Affairs, the Department of Education, which in turn, will continue to use the Commission's current operating budget. As such, the Bureau of Higher Education's budget will be allocated based on the Commission's performance and on the performance of any subsequent management structure. Because we did not receive the Federal Government's proposal or its offer in writing for over two months, we were not able to offer our responses to the proposals prior to the July 1 deadline and our decision remains subject to formal consideration and approval by the Commission. However, on July 30, we informed the Commission that we will cease to fulfill federal student loans for the FEEL Program on September 30, 2010, at which point the FEEL Program will no longer be available to students and families in California through our agency and, therefore, the Federal Government will no longer be obligated to make any payments to us through the Federal Student Loan Program through that date.
