In addition to its amended notice, GDR filed a supplemental notice of final action on December 6, 1998. The Federal Highway Administration received notice of GDR's exemption request on July 6, 1999, and is taking an initial position on the request. See Federal Register publication 94-51, February 27, 1999, p. 64-70. GDR filed an Amendment to its Notice of Proposed Abandonment (NPA) on March 17, 2000, to withdraw its proposed abandonment. GDR filed its Notice of Final Action on May 5, 2000, withdrawing its proposal. On June 7, 2000, the Department sent GDR an inquiry re this action. On September 16, 2000, GDR filed an amendment to its Notice of Final Action adding a request for a Federal Emergency Management Agency (FEMA) emergency declaration to allow railroad operations to restart. The Department responded on November 1, 2000, directing GDR to submit a request for the declaration no later than December 13, 2000. This action was denied. On February 26, 2001, the Department sent a further request for a FEMA declaration on January 28, 2001, which was again denied. On September 6, 2003, FEMA completed an analysis of GDR's request, but directed that the request be filed no later than December 3, 2003. This action was filed after FEMA's conclusion of the evaluation, and GDR did not submit the request for further consideration. GDR did submit a request for authorization of emergency use of a highway tunnel, but the authorization was denied. On January 20, 2005, GDR filed a third amended notice of proposed abandonment which indicated that the abandonment was proceeding pursuant to GDR's request for an evacuation order. The Department has received a further request for evacuation order with a proposed withdrawal of a proposed abandonment on September 8, 2005. On April 2, 2009, GDR filed a fourth amended notice of proposed abandonment, and received notice of the abandonment's effective date on October 27, 2009. On September 10, 2010, GDR filed a fifth amended notice of proposed abandonment, requesting an evacuation order to be rescinded and to withdraw a request for FEMA assistance to initiate the abandonment process.
