An applicant will continue to be eligible for Licensee Authorization before the NRC can make a determination that the application is in accordance with the license policy. The NRC is also authorized, without further action by the U.S. Congress, to suspend an application for a license to export LTD based materials from the United States until the Licensee Submitter responds to the NRC's request for clarification of requirements. (In addition, a NRC suspension order may be issued under section 3.5.2.17 of the Atomic Safety and Licensing Act [ASA] and under the Nuclear Nonproliferation Act [NBA]. [Authority for suspension is in addition to, and not subject to, any statutory or regulatory requirement.
