MORAN PRESIDENT JANUARY 2008 MAINTAINATION OF A PUBLIC HEALTH STANDARD FOR THE STATE, THE DISTRICT OF COLUMBIA, AND THE PROVINCES OF CANADA PART I AMENDMENT REGULATION OF DEPARTMENT OF ENVIRONMENTAL ISSUES IN RELATION TO SOIL AND WATER PROTECTION SEC. 508. No part of or any amendment made by this title, or part or substance in any such amendment, shall have the effect of altering or affecting the authority of the Environmental Protection Agency under any law or regulation related to the protection of the public health for the purpose of modifying any provision of those laws and regulations, or in any way waiving or diminishing the authority of the Environmental Protection Agency, unless the Director of the Agency or his delegate determines in writing that one such modification is in the public interest and that such other modification may be made consistent with the public interest. SEC. 509. The provisions of section 524 of the Environmental Protection Act Amendments of 1990 shall apply to and be considered as part of and an integral part of the provisions of this title. SEC. 510. (a) In General Not later than 30 months after the date of enactment of this Act, the Secretary of Health and Human Services shall issue regulations applicable to the State plan amendments pursuant to section 1513 regarding access to, and the payment and coverage for, the services of a qualified environmental health specialist. (b) Regulations Such regulations shall provide for one or more of the following: (1) Requiring payment methods consistent with section 925(b) of the Social Security Act after the date of enactment of this Act, including by reason of a person's age (or if such person is disabled, reason for such disability), the number of months of life in which such person would be eligible to receive benefits under such section 925(b) if such person were a full-time employee of a health care provider. (2) Provisions relating to cost sharing for environmental health services furnished or incurred by a qualified Environmental Health Specialist. (3) Provisions relating to a requirement for payment or reimbursement, as appropriate, for certain items of service relating to environmental health services furnished or incurred by a qualified Environmental Health Specialist. (4) Requiring an environmental health specialist who furnishes or incurs environmental health services to be licensed and registered pursuant to the Act. SEC.
