The State Fire Marshal has the authority to investigate reports of fires and injuries resulting directly or indirectly from the actions of the public safety agencies listed in subsection e of Section 2 of Article II of the Constitution of Massachusetts relating to public safety. 3. The State Fire Marshal shall investigate reports of fires and injuries in a timely manner and shall provide a fair and impartial investigation. 4. The State Fire Marshal shall have the authority to conduct a review of any report prepared by a licensed physician or surgeon as provided for in Section 31.5 of the Massachusetts Medical Practice Act. State Fire Marshal s annual report on the Massachusetts Burn Injury Reporting System is an annual accounting of the extent of the State s burn injuries, the number of burn injuries recorded by this agency annually, the number of reported injuries identified. The report can be used in the event of an investigation into a report of a fire or injury resulting in an injury resulting in the death or serious personal injury of any person or in the event of a fire or injury causing the substantial destruction of property and may be relied upon in connection with any law enforcement investigation. The State Fire Marshal may request an independent investigation into any report concerning a fire or injury which appears to have been caused by the action of another person. Whenever the Commonwealth of Massachusetts determines that a report by the State Fire Marshal regarding the public safety and security needs of the Commonwealth is not sufficiently complete, the State Fire Marshal shall promptly provide a detailed written report of the deficiencies and, if appropriate, recommendations to the Governor, or the State Fire Marshal, the Attorney General, the Department of Public Safety, and the Department of State Police. The report shall be forwarded to the Governor, the Chief Executive Officer of the Department of Public Safety, the Office of the Attorney General, and the Department of State Police by the department in the form and manner designated by these officials. 6. Whenever any investigation is conducted in accordance with this section, the State Fire Marshal shall have the authority to conduct interviews. Any person aggrieved by the refusal, refusal to grant, or refusal to accept a request for decoration, shall have the right to challenge the decision in the circuit court located within the judicial district where the records are located. 8. Any action undertaken by a law enforcement agency is subject to review under Article VIII, Section 9 of the Criminal Justice Act (1848).
