HILL Assistant Special Agent-In Charge, FBI Boston FINDING 6 There exists in New Hampshire a retail liquor store franchise that operates under certain conditions set forth in N.H. Rev. Stat. § 531:30-2. These conditions include: the sales of spirituous liquors at a reduced price to patrons of the license; the purchase of spirituous liquors from liquor retailers licensed pursuant to this section and from distributors who have been designated by the State Liquor Authority to receive from such retailers the spirits; and sale by a licensee to its employees or agents of any quantity not exceeding six hundred and fifty-nine bottles of spirituous liquors per month on its license. SUMMARY OF THE INVESTIGATION The New Hampshire State Liquor Commission (Liquor Commission) reviewed the application for a retail liquor store franchise application from New Hampshire State Liquor. In connection with the review, the Commission received three written complaints (as described below), two from the State Commission and one from the Secretary of the NH Liquor Authority (NOLA). The Complaints were received by the Liquor Commission on June 28, 2005, from the NH Liquor Authority because the Complaints alleged violations of NRL § 532:12-a(2)(i). Those Complaints alleged that: 1. The proprietor of the proposed premises, Joseph Roundel of Concord, NH, did not possess a license for the premises; and 2. The proprietor and the agents of the proprietor did not have a license to sell spirituous liquors at the proposed premises from November 22, 2004, to May 26, 2005, as required of all licensees in New Hampshire. The Complaints were made to the NH Liquor Authority by the NH Liquor Authority on June 22, 2005, and June 26, 2005, respectively. The NH Liquor Authority is the New Hampshire Department of Liquor Control. At the same time, the Complaint also alleged that: 1.
