The Department of Health and Human Services developed an initial WIC program under section 21 of the Child Nutrition Act of 1966 to help meet the nutritional needs of low-income women and their offspring. The Department initiated operation of the original WIC program on 7/29/87, and later increased the number of beneficiaries from 6,650,000 in 1985 to approximately 22,000,000 in 1995. The program has provided supplemental foods at a nominal cost since the inception. However, beginning after 10/31/88, the cost of purchasing and delivering these supplemental foods is borne by the states. For more information about WIC, visit: The WIC Nutrition Program is not part of the public health program administered by HHS. The food available is not part of the general food supply. However, the State must meet all Federal requirements concerning nutrition information and school breakfast program participation. The state's responsibility does not extend beyond the requirements of the federal law. The State may have its own nutrition standards and certification process. A state's responsibility includes compliance with all state nutrition standards adopted before the effective date of this order. WIC Supplemental Nutrients and Health Claims The term ``WIC Nutrition Program'', when used in the nutrition context, means the program administered by the Department of Agriculture under section 21 of the Child Nutrition Act of 1966. Under the Food and Nutrition Service (FNS), the Secretary may approve nutrition claims for foods purchased through the WIC program. However, claims may not be made for: (1) a nutrient for which there is not a reasonable basis to justify such use; (2) that is not reasonably expected to interfere with the nutrition of a child's diet; (3) products which are not reasonably expected to be consumed; or (4) that would result in an unreasonable waste of government resources. The Department will not approve or publish any WIC Nutritional Claims for foods sold through the WIC Program, but will encourage WIC Supplemental Nutrition Program participants to report complaints and concerns regarding inaccurate nutrition claims or misleading information when providing reports or complaints. The Department will provide WIC Supplemental Nutrition Program participation with the highest food quality rating available. In addition to the current WIC Nutritional Claims policy, the Department is also considering the possibility of updating the current standard to conform with the United States Department of Agriculture's (USDA) standards for food information and nutrition claims.
