In this scenario, a lower court judge would decide the joint issue (the ultimate constitutional question) and an intermediate court judge and Supreme Court justice (or in some rare instances, the Chief Justice) would decide the intermediate issue on the facts of the case. © The courts have absolute judicial power over the cases that arise under the Constitution, laws of the United States, and treaties made, or which shall be made, under their authority. The United States does not “give judges the power of a corporation”. (In fact, when Congress passes a statute, the judges must interpret the statute in an effort to preserve its original meaning, which is what was intended by the legislators; see U.S.C. sec.
