The Board approved an interim plan for marijuana businesses, which includes a temporary moratorium against the cultivation of cannabis and cannabis concentrates until the Oregon Legislature has enacted legislation.  At the Board meeting, Board of Directors Chair Dorothy Hudson explained that the moratorium is in place for the period “for the Legislature to act on the regulatory framework for MM.” Hudson went on to explain that the moratorium, while temporary, will allow Oregonians to prepare for changes to the existing Oregon Medical Marijuana Regulation and Safety Act (MALTA) that she described as a “bold new approach.”  Ms. Hudson stated, “The interim moratorium on the cultivation, production, testing and transportation of cannabis is in the name of providing a 'check point' for the legislature and an opportunity for our community to prepare.  As a first step towards introducing an entirely new law, and in response to strong concerns, we have created an opportunity for some community members in Oregon to begin preparing for the future.”  The interim moratorium is “a temporary measure until our Legislature and Governor have time to take action in order to provide lawmakers the opportunity to enact legislation that can best meet the needs of Oregonian families and patients who rely on medical marijuana for pain relief, and provide reasonable access for patients whose illness is not alleviated by other medications.” The moratorium is in place to allow lawmakers time to address concerns raised by patients as it pertains to the safety of their right to access medical marijuana.  In addressing concerns raised by patients during the public comment period at the August 27th Public hearing, Hudson stated, “The state has a responsibility to provide safe access to a medicine that many doctors use as a therapy, and many patients use as a pain treatment.  Our doctors, particularly physicians who work for large hospitals, have an obligation to work to create safe access to it. They also have an obligation to follow the law as it is written.  The legislature and Governor have made it crystal clear that this medicine is safe.  The law that was enacted last fall makes it crystal clear that it is legal for Oregonians to use the medicine to treat symptoms of their illnesses without a prescription.” Ms. Hudson also stated that the interim moratorium was in place to provide patient groups time to prepare for the eventual passage of new legislation that can best address their medical concerns on behalf of patients while avoiding any unintended negative effect on the new industry that may arise.
