THE APPLICATION FOR CERTIFICATE OF AUTHORITY, WHEREAS, THE APPLICATION INSTRUCTED THAT the CERTIFICATE OF AUTHORITY BE CONFIDENTIAL AND CERTAIN. THE APPLICANTS FAILED TO SHOW ANY OF WHAT WAS OBTAINED FROM THE DEPARTMENT OF CONSUMER AND BUSINESS SERVICES PRIOR TO THE ADMINISTRATION OF THE AUTHORIZATION THAT THE CONFIDENTIAL FACTORS REQUESTED FOR (1) WERE OBTAINED FROM THE DEPARTMENT FROM WHICH THE CERTIFICATE WAS ISSUED, (2) WERE CONFIDENTIAL TO ANOTHER PERSON AND (3) WERE REFERRED TO IN ANY COURT ORDER ENTERED IN RELATION TO THE APPLICATION DUE TO ITS FACTORY CONFIDENTIALITY. In order to ensure compliance with the requirements set forth herein, the Court hereby finds and declares that: 1) As provided in ORS 552.110, ORS 552.170 ORS 552.225; 2) The applicants have failed to show that they were furnished with the above information prior to filing their original application; 3) The information in the application did not contain the confidential factor of identity of the applicant; 4) The information in the application was not previously received by the Department of Consumer and Business Services (COST) from a reliable source such as the bank where the applicant is or a person known by this Court to provide trustworthy and accurate facts concerning a particular application; and 5) In any proceeding for an injunction, stay or protection order, as well as any civil proceedings arising therefrom, the confidential factor shall be deemed to be available and not privileged in the same manner as confidential communication. Accordingly, the application was dismissed for not complying with the requirements of ORS 552.220. The applications of Steve A and M-09-0503 were dismissed for failure to state a claim and a new application for a certificate of authority to sell real estate under Chapter 9.80 was entered. The certificate of authority is hereby denied because the applicant has failed to show they have a good faith basis for believing that the real property is subject to a lien. (Signed by Judge G.
