194, Section 21.195 and Section 21.198; (B) Where the person engaged to employ such transportation of persons for hire fails to pay over the tax or to pay any sum of money collected hereunder within the time fixed in this Section; © Where the person engaged to employ such transportation of persons for hire fails to pay over the tax to the Tax Collector or other proper officer in accordance with the rules of the Tax Collector; and (D) Where the person engaged to employ such transportation of persons for hire fails to comply with any other provision of this Chapter. In case the Tax Collector finds such person liable for the tax under subparagraph (B), the Tax Collector may recover from such person an immediate refund of tax or may issue and collect a separate payment in an amount equal to the tax so collected, together with interest from the payment date at the rate prescribed in Section 8-103.5 at a rate not to exceed the maximum rate allowed by law at the time such interest became due and payable pursuant to Section 9-104 of the Code of Civil Procedure. (b) Upon receipt of a proper application made in such manner, form and manner prescribed by the Tax Collector, a notice of liability shall be issued to the taxpayer or to the person or persons liable for the tax, setting forth the reasons for such finding and advising the taxpayer or such persons to appeal to the Superior Court of the county in which the taxpayer resides or does business in order to obtain from this City any refund of tax owed according to law. In this case, if the taxpayer or persons liable for the tax fail to take the appeal within 60 days after such notice has been mailed, the Tax Collector shall refund all amount due under this Section. © The Tax Collector is authorized to accept the payment thereof if (i) the taxpayer or persons liable for the tax is in arrears in the payment of the tax due as of the date of the notification, and (ii) in the case of notice to a person liable for the tax, the Tax Collector is satisfied as to the amount of the tax to be refunded.
