1The following rules are made in addition to the rules referred to in paragraphs 1 to 6 of this Executive Council Order: (a) the search warrant shall set out that it is being issued by the Financial Markets Authority under sections 4 and 5 of the Financial Markets Authority Act 2011 and may set out the matters set out in those sections; (b) the warrant shall provide the relevant name, street address and telephone number of the person to be searched; (c) the warrant shall be signed by the executive officer authorized to issue warrants under section 7 of the Financial Markets Authority Act 2011; (d) the warrant shall be carried, in the presence of the executive officer authorized to issue warrants under section 7 of the Financial Markets Authority Act 2011, in the presence of a sworn person of the executive officer; (e) the warrant shall bind the person being searched to comply with the warrant, and shall recite or constitute a statutory declaration made in the case of a search of the person's residence, that the person is being searched for purposes connected with an investigation of a breach of a prudential rule of regulation; (f) the search warrant shall contain or specify whether an arrest warrant has already been issued for the person being searched with a view to the arrest of the person being searched if, as a result of the search, it appears that the person has committed an offense; (g) a copy of the search warrant shall be given to the person being searched, at the person's request, along with an invitation to make a statement to a Parliamentary Commissioner for Estimates by the person being searched or by another person designated by the person being searched or a person authorized by the person being searched who is to make the statement; (h) no person acting on behalf of another shall be in a position to effect any search, and a person or organization who has obtained the person's authorization to make a search shall not be in a position to do so; (i) any person who is arrested or detained or who is on bail for or on remand in relation to an offense may be searched without an arrest warrant provided that (i) a search of the person does not relate to any other matter or to any matter for which it would be unlawful or contrary to this Act to refuse a warrant, and (ii) in any case where the warrant authorizes a search to be carried out and a person being searched cannot be given permission to search because the person, without good reason, does not want to or cannot be searched and the person searches, the.
