If it is determined that the restoration process can be expedited, or if a decision is requested that a particular member's membership of the BC limited liability partnership be terminated, then the BC Court of Appeal will have the power to do so and to appoint a retired judge of the BC Court of Appeal to preside. If it is determined that an individual member is entitled to a full restoration under the BC Business Corporations Act, the Court will have the power to appoint a retired judge of the BC Court of Appeal to preside. This process must be completed within a total time of 45 to 60 days. If the individual member is not satisfied with any aspect of the restoration process, they have the right to appeal the decision to the BC Court of Appeal. To facilitate the full restoration process, the Registry of Companies will not accept or issue applications for a full restoration. The restoration process must not exceed the 60-day period within which a BC LIMITED LIABILITY COMPANY needs to be registered with the BC Supreme Court Registry of Companies.
