What is the process to appeal a variance? For applications between November 1, 2015, and February 15, 2016, a variance may be appealed directly to the Committee of Adjustment. For applications from February 15, 2016, on or after February 15, 2016, the applicant should send either a signed petition, a verified complaint, or a certified copy of an order or determination by the Land Standards & Development Appeal Board (LG DAB) that is issued within 30 calendar days of the application and that contains the opinion of the LG DAB on the application. For this reason, a variance application should be brought before the Committee of Adjustment no less than 30 days before the due date for the variance order. Applications for variance orders that are in the process of being heard by the Committee of Adjustment may be submitted to the LG DAB.
