A bylaw is a provision of Vancouver Municipal Code which provides specific rules for specific matters of municipal law within the City of Vancouver. A bylaw can also regulate the activities, conduct, or use by members of the public of any City of Vancouver right-of-way or a municipally owned recreational facility or facility of the City. The City can make regulations that specify specific situations and circumstances under which, under the provisions of a bylaw, a bylaw enforcement officer may proceed with an enforcement action. The enforcement action can be directed against a person for a number of reasons, including, but not limited to, by causing a breach of a bylaw; to protect the health, safety or welfare of any person or property; to resolve a dispute, or to enforce a provision of a bylaw. In cases where the matter is not covered by a bylaw, as a by way of derogation from an established practice or rule or from a direction by the director or the police, or of a police officer: a bylaw enforcement officer acting under a warrant or a direction from a police officer; a police officer acting under a valid search warrant of a residence or other property, or when the officer has reasonable grounds and probable cause to believe that: there is on the property a criminal act, an offense, a contravention of an undertaking or a condition, and the property is there for the purpose of committing or being used in the commission of the offense, offense, contravention of an undertaking or condition or being used in any other manner for the purpose of committing any offense; or an offense, an offense under a lawful direction or a condition, has been or is being committed and the officer is authorized by law to enter, inspect and examine the property to determine or verify the facts of a situation. The terms, “bylaw enforcement officer”, “police officer”, “deputy”, “officer in charge”— as well as the various classifications— are defined and explained in the relevant sections of the Vancouver Municipal Code. A bylaw cannot be changed through a resolution of Council, but it may be amended by a notice of hearing or resolution in Council and will be subject to amendment and cancellation by a bylaw review committee before it becomes fully effective at the beginning of the next full general municipal election for which the applicable council has been elected under the municipal law.
