At any time until the gaming license applicant is issued a gaming license, a state official or employee, including, but not limited to, an attorney, may issue an affidavit under oath or affirmation in a gaming facility or public building for purposes of identifying the applicant, stating the specific reasons for the affidavit, and identifying the applicant upon whom it is based. 2. At any point in time after the licensing applicant meets the eligibility requirements, an affidavit may also be issued by the applicant's attorney on behalf of the gaming facility (or designated employee's) pursuant to subsection 3. 3. If the state official or employee is not available or unable to complete the affidavit and identify the applicant, it may be executed by his/her employee or other responsible individual who has been authorized by the gaming facility owner or operator.
