2. Except as otherwise provided in subsections (2) and (3), a fee of 40 per lot is payable for water for municipal purposes. 3. A person licensed to conduct inspections shall be entitled to recover all costs of conducting inspections incurred by the municipality, subject to subsection (6). (1) The fees set by the municipality for the purposes set out in subsection (2) shall not exceed the maximum fee rate set by the minister pursuant to subsection (2) of the Water Resources Act. (2) For a lot that contains an infrastructure that has been installed as a water supply line or sewer line, or that is required as a requirement of the Act, regulations, declaration, by-law or by-law of the council referred to in paragraph 2 of subsection (1) and, in relation to which a certificate of a municipal engineer appointed in accordance with section 10(2) is held in the municipality, the municipality may charge a fee for obtaining an environmental approval that may not exceed the costs of the environmental approval, except for costs incurred before the Environmental Protection Act, 2007, came into force. (3) In calculating the fee payable by the municipality under subsection (2), as determined by the minister, including costs for (a) consulting with the council and the municipal engineer with respect to the lot and the environmental approval and other matters concerning the permit, (b) providing the fees set by the provincial council pursuant to section 27 of the Environmental Protection Act, 2003, or for the inspection and sampling of the water for municipal purposes that relate to the lot, (c) obtaining the certificate of a municipal engineer as required in subsection (2) (b), (d) setting the fees specified in paragraph 2 of subsection (1), and (e) conducting the water sampling, the municipality shall subtract the fees set by the provincial council and any amounts that have resulted from a refund under section 23 (1) of the Environmental Protection Act, 2003, and of any amounts that have been refunded under section 23 (1) of the Water Resources Act, 2007. (4) All fees received under subsections (3) and (2) shall be remitted to the ministry. (5) If the minister considers that an additional fee is necessary to protect the public and to ensure public safety, the minister may, despite section 27 of the Environmental Protection Act, 2003, require additional fees, as determined by the minister, that are paid by the municipality.
