Forms N-848 may be used to sign contracts, obtain business receipts, execute and file tax returns, obtain refunds, make legal, accounting, and similar tax matters. N-848 is not for tax advice. Forms N-848 are not to be used by anyone other than a qualified Hawaii tax preparer. (§ § § N-848 and -849). The Power of Attorney must include the person's full legal name, date of birth, Hawaii`i driver's license number, and a declaration that the Power of Attorney is not intended to be a substitute for, and cannot be used to circumvent, the requirement of an individual's signature on the person's own tax return. Form N-848 may be requested (§§ § N-848 and -849). Power of Attorney and a Power of Attorney to file Tax Forms N-848 are required to be signed by a person qualified to sign the Power of Attorney under Section N-842(3) to sign documents on behalf of a person with an Individual Power of Attorney, a person with a Power of Attorney to file a joint return, or to sign any other form by a qualified individual to sign the person's own IRS form. It is the responsibility of each person to make sure that the power of attorney is signed and verified. The Power of Attorney is effective at the commencement of the year following the certification date or, in the case of a taxpayer who is claiming an exemption for the taxable year with which notice of a deficiency period is due, that date to which notice of the filing of a return or return extension is due has elapsed. However, if the taxpayer does not claim an exemption for the taxable year, the Power of Attorney is effective for the entire taxable year. Form N-848 can be used to apply for benefits if the individual who is applying for the power of attorney is certified by a duly constituted IRS organization as properly requesting the services of the organization. Any request for such an exemption must be accompanied by a statement from the taxpayer or the taxpayer's representative certifying that the individual is a person legally qualified to make the request. It is the responsibility of each person to make sure that the individual requesting the benefits is certified as an individual authorized to make the request and that the individual is entitled to all benefits resulting from the application.
