A business must be issued a Certificate of Occupancy, as well as the necessary other certificates, when its construction has complied with all relevant provisions of State and federal laws, and has been authorized by the Air Pollution Control District to conduct business under the permit. A, a City or County will issue Certificates of Occupancy for all construction that has been completed as soon as possible after the start of construction, and before an application for the permit is denied. The City or County does not maintain a list of buildings where, as a result of the Air Pollution Control District's actions or the failure of the business to comply with the law, a certificate has been issued. Nor does it maintain a list of buildings where, as a result of actions of a City or County, a Certificate of Occupancy has not been issued. A City or County will permit any and all construction which has been completed or permitted that is subject to the Air Pollution Control District's authority. A City or County will not prohibit any proposed business activity in a particular location, even if prohibited actions were the cause of the Certificate of Occupancy or if, as a result of a permitted construction activity, a Certificate of Occupancy was not issued. This paragraph does not prohibit a City or County from exercising reasonable diligence in considering any construction activity on a case-by-case basis in light of the applicable laws. If such a construction activity cannot be permitted in the city or county for a variety of reasons, including construction which causes excessive smoke or other air pollution problems, a business will still be permitted to operate from the premises, and not be evicted or arrested.
