A brief historical introduction is given in Annex. In June 2006, the FRA was constituted under the terms of its existing mandate by the Accession Treaty for a year ending in June 2007 and is constituted as a Member of ETA in accordance with Article 1 of the Treaty. This Report is intended, therefore, to provide an overview of how the FRA is working within the framework established by the Accession Treaty and in keeping with the mandate given to it by the European Union as provided by the Treaty of Accession, and is also intended to be a reflection of the work that the FRA has undertaken, including on specific themes covered by the FRA mandate. The Report is therefore not intended, and cannot be, a report solely of the FRA's findings and conclusions for that year, nor a report solely of the activities carried out by the FRA. It is a reflection of the working of the FRA by an author(s) chosen by the FRA. It is the author's responsibility to ensure that the report complies with the reporting criteria laid down in the Annex to the statute in which it occurs and the general criteria for the publication of European Union Agency for Fundamental Rights annual reports (see Annex). In March 2007, when the Directorate commenced work on the Report, no Member State had applied the “new” provisions on the publication of annual reports by ETA, which introduced a special procedure for ETA Member States whose first annual report was published before 1 January 2005 and by which ETA Member State published a national report before 1 January 2006 following the Accession Treaty and the application of the “new” provisions for that country. This report is therefore an Annual Report for each ETA Member State, which will be published in two Parts in August and September 2007. The Reports for ETA Member States are also intended to give an indication as to what a Member State's legislative and administrative framework for addressing problems related to human rights may be and for other Member States that have not applied or still do not apply the “new” provisions on the publication of national annual reports. The reports will be available online: for example, on ETA Member States' websites. The FRA reports were published in 2008, for the ETA Member States of Iceland Norway and Liechtenstein, and from the EU institutions' website. The Reports for ETA State of Montenegro and Bosnia and Herzegovina are still under preparation.
