Anderson has not, and cannot get the trial court to dismiss the case, for there is no reason in law, nor any reason in common sense, why there should be a requirement that the parties obtain a divorce to file a petition for the issuance of a domestic relations license under the provisions of the Uniform Premises Liability Act and the Ohio Code of Criminal Procedure. Therefore, we do not abuse our discretion in this situation, and we agree with the trial court's conclusion that there would be no reason for the trial court to have dismissed the complaint for divorce, which is not to say that the trial court's decision is without discretion, for the trial court made a factual error in dismissing the case, as we have set forth. Nevertheless, we do not abuse our discretion in doing so and we concur in the trial court's conclusion that there would be no reason for the trial court to have dismissed the complaint for divorce, for the purposes of this appeal, because the trial court has a power granted by Article IX of the Ohio Constitution, “To hear and determine cases arising under this Constitution.” The trial court erred in refusing to award Mark Anderson a divorce.
