The FDIC's statutory obligation to notify or notifying an insured's policyholders in accordance with section 19- or the applicable state law: A. Notification. If the FDIC receives a request for a letter of rescission from an insured, it must send a notification letter to the insured by registered or certified mail stating the insured's right to rescind his or her policy, and the policyholder's right to request a rescission letter. The letter: 1. States that the insured is entitled to rescind his or her policy and that the policyholder is entitled to rescind his or her policy; 2. States the right of rescission and the policy withdrawal right of policyholders if a letter of rescission has not been obtained; and 3. Provides the insured's policy number, which may not be used as a personal identifier on the national registration form; and 4. Requires that the insured notify his or her policyholders in writing of any rescission and the right to the policy withdrawal. B. Policy withdrawal. The insured who receives a demand for a rescission must notify the policyholder within 5 days by registered or certified mail of such rescission, stating the insured's rescission right. If written notice is not received within 5 days, the insured must use the national registration form as the method for terminating coverage. Failure to do this within 5 days after being notified of rescission is considered a breach and the insured can recover reasonable costs and attorney fees from the policyholder. If the policyholder rescinds coverage on behalf of an insured, the policyholder is not liable for the insured's breach. The rescission procedure specified in paragraph 1 also applies to insureds who do not respond to the request for rescission within the time specified in paragraph 2 of this section. Note: An insured or his or her agent who declines to rescind a policy is liable for the rescission fee, provided the insured was advised by the insured's policyholder of his or her right to rescind and his or her agent did not decline the right to rescind or for any other reason. §19.4 Acknowledgement of rescission (Section 19.2) A rescission letter sent in the form of an insurance identification card and provided upon demand, shall be considered to have been sent by the Federal Deposit Insurance Corporation for purposes of section 19 and, if not otherwise required, shall be returned to the sender as promptly as practicable after being received.
