Complaints to the Medical Board are filed by any person having any reasonable cause to believe that a health care provider, resident, or student fails to meet a licensing standard or responsibilities.
A licensee may be sanctioned by the Board for failing to meet licensing standards and responsibilities, if such failure:
(1) is demonstrated by objective, reliable evidence to be attributable to the licensee rather than to an otherwise qualified health care provider; or
(2) results from the licensee's or a resident's intentional or knowing violation of a standard or contractual obligation applicable to the conduct of the licensee or resident, which violation was not discovered by the licensee or resident prior to the complaint. “Intentionally wrongdoer,” as used in the definition of “knowingly” in Section 826.5 of the Business and Professions Code, means a person who has the legal or moral duty to act to avoid or correct a wrongful act or omission committed by another party, for example, a physician who fails to examine a patient or fail to report a patient with a life-threatening condition.
