Colorado, September 4, 2007 (U.S.A.) — As a practical matter, there is no single uniform procedure for determining whether new or proposed trade or service marks are confusing. Most often, the decision to register or deny registration depends on factors such as whether the marks are used widely; whether they are confusingly similar; and whether someone claims the mark has been confused with his business or other marks. However, the Office of the Colorado Secretary of State publishes annually a Register Information report (“Register Report”) that provides information on proposed trade or service mark registrations as well as on the status of pending and final registered trade or service marks in Colorado and the jurisdictions served by Colorado. This report does not attempt to review the validity of the marks that have been registered. The Register Report contains the following information: The names and addresses of all applicants, holders of registered trade or service marks, and registrants who have applied or granted the permission of the Secretary of State to use their trade or service marks in Colorado in any manner. This report has not received final notice of any application or permission granted to use trade or service marks. Registrants and applicants are entitled to obtain copies of this information upon request, and are advised to consult a legal advisor if any concerns are raised about this filing. The Register Report also reflects filings of new limited liability companies (“LCS”) and new Covered Entities, except (1) new LCS registered in the state of Washington, and (2) new “Covered Entities,” including the New Company Act of Colorado (see Chapter 9).
