Contract Department Opt-out Notification Opt Out Notification There is provision in the Conduct Regulations 2003 for companies and those workers whose services they supply, to opt out of the Conduct Regulations 2003. To opt out, post a letter to Contract Department which tells us: a) the full name of the company in which you are providing services; and b) what you and the individual for whom you are supplying these services wish to opt out of the Conduct Regulations 2003. In this letter make clearly stated what you have done in the past and what your intentions are for the future. By signing this form and/or sending it by post, you are: a) informing Contract Department that you wish to opt out from the Conduct Regulations 2003; and b) opting out of the Conduct Regulations 2003, which requires you to comply with the following provisions which are a breach of this clause: a) the Conduct Regulations 2003 applies to you; b) by supplying the work requested or providing access within the scope provided by the Conduct Regulations 2003 which relate to the person's work, (for example, by providing access to information for the person who is supplying the work requested to enter the site of a building, a work location and/or a facility, as permitted by the requirements above; and/or by providing access to the public for the purpose of entering the premises, as permitted by the requirements above; and/or by offering the person who is supplying the work requested access in a restricted area, as permitted by the requirements above) you are giving up one or more of your rights under the Conduct Regulations 2003 or, if the person for whom you do the work cannot be identified, you are giving up the right to access the personal data or other material of that person. Opt out from the Conduct Regulations 2003 Opt out notification Opt Out Notification The individual or company to whom you will supply your service or the work requested must enter into a contract with you to comply with the requirements of the Conduct Regulations 2003, which is to be notified as Opt Out Notification. Where the individual or company for whom you do the work cannot be identified, the requirements of Opt Out Notification must be included in a separate agreement. In these circumstances you must inform Contract Department as Opt Out Notification within 3 months of the individual or company making a contract with you.
