1. General Provisions for the Transfer of Information and Records A State may not require the transfer of personal information unless there are reasonable grounds for determining that: The purpose for the transfer is in accordance with law; and The individual's personal information: Is to be held by another State or authority that has jurisdiction over the individual; Is to be kept separately from the personal information of other individuals; Is necessary to achieve that purpose; and The purposes and circumstances of the transfer are not contrary to the right of the individual to respect for his personal privacy. A State that transfers personal information to another State may also use the information and records transferred for non-discriminatory purposes (see A.1.b.1.); however, the person from whom the information or records are collected, the purpose of the information or records and the degree of security provided by the person from whom it is obtained shall be considered when deciding whether to use the information or records for non-discriminatory purposes (See also § 1.11). Information or records shall be transferred in accordance with such safeguards as the Federal Commissioner of Personal Data and the General Counsel of the European Data Protection Board may, by agreement, require under paragraph 3 of Title IV of this Directive and in accordance with the principles set out in A.1 and A.5 of A.1.b, but not in such a manner as to circumvent the provisions of article 29 of the General Data Protection Regulation (GDPR) regarding the protection of privacy of individuals by transferring personal information. 1.2. Requests for information and records A State may request the information and records that are needed for a State to perform its functions and exercise powers as defined in the provisions on transfers described in paragraph 1.1. A State shall respond to any such request within a reasonable time after it receives it. 1.3. Restriction on disclosure. A State shall not, to the extent that the processing of personal data is necessary in the interests of national security or for other reasons of public interest, disclose personal information or records to any external authority unless such disclosure is based on a judicial order or is prohibited by a request from a person, including, inter alia, another State or authority, under A.1. b. 1 or A.1.b.2. 1.4. Consent to processing. A person may give his or her consent to the processing of his or her personal information for the purposes for the transfer to the State concerned.
