In addition, only a certified public accountant or certified public tax accountant is authorized to certify exempting organizations or subdivisions for purposes of this exemption. Each application for a Certificate of Exemption must include: (a), a certified copy of a state-approved business tax license, (b), a letter from the state-approved business tax office certifying that the applicant's business is duly licensed; (c), proof of exemption from sales and use taxes, (d), a sworn statement by the applicant stating the type and amount of items sold for consumption, and (e), a sworn statement by any applicant representative or employee stating the applicant organization is exempt from such taxes. A separate application is NOT needed for each type of exemption from sales and use tax. A Certificate of Exemption is required for each exemption for which it is issued (see page 5 of the application form). As a condition for the issuance of a Certificate of Exemption, a political subdivision or nonprofit organization requesting a certificate of exemption must meet all other requirements of this rule which also authorize that entity to qualify for the exemption. Each type of exemption from sales and use tax must be separately identified along with an expiration date (see pages 5 and 6 of the application form). 4. Application Information. The application for an exemption from sales and use taxes must be signed by (i) each applicant, (ii) each officer, director, manager, owner, or other person authorized to sign, and (iii) each person directly responsible for the acts described in the application. The signature of each person signing must be notarized at the time it is received by the Division. Unless otherwise stated, each application must contain the same information as is contained in a separate application or separate letter for each exemption from sales and use tax. 5. How to Apply for an Exemption. (1) Application. Applications for all types of exemptions from sales and use taxes must be made to the Division. Each application must include all the information required in a separate application or separate letter for the exemption for which it is issued. Except for a Consumer s Certificate of Exemption, the applicant must certify that the applicant organization has met all requirements or conditions for qualification of the applicant's subdivision to receive the exemption (see page 5 of the application form). (2) Application for Exemption from Sales and Use Tax. Each exemption may be applied for through one application or separate letters.
