An original and one copy of any necessary documentation. The documentation may include, for example: 1. A written agreement regarding the right of way and any related documents, such as insurance policies. 2. A plan of operation for access from the easement for legal, engineering, and construction purposes. 3. A statement from the contractor stating that they are entitled to access their easement. This includes not only the right of way, but the work site, equipment and materials in the easement itself, and work site materials. 4. A copy of the written and signed lease agreement from the easement owner, if one exists, or a copy of the written and signed lease agreement of the contractor specifying their right of way in connection with the easement. 5. The location and extent of the easement. If the property line lies along either a rural road or a state highway, the information requested should include the location of the line on the map. The exact map showing the line must be attached to the application. The map must be marked clearly with a marker at the line of the easement, indicating the location of the easement and indicating the name, address and telephone number of the easement owner, if any. 6. The size of the easement of which the applicant is requesting access, and its total area not including any drainage area. If the proposed easement involves drainage or runoff, the applicant may request an engineering survey. If so requested, the Department shall conduct an Engineering Survey to determine the total drainage area and any adjacent lands to be affected by the proposed easements and the impact of access thereto. 7. The total number and the types of structures and equipment to be removed and replaced pursuant to the easement. 8. The effect of access on adjacent land use and its effect on adjacent private property and easement owner rights, including rights of way. 9. A list of all state and federal lands in or adjacent to the easement, as well as any federally owned lands within 30 feet of the proposed easement. For easements on State owned property, the Department will send copies of the map showing the boundaries of the state land or state highway and the names and addresses of owners with respect to the state land or state highway. Where practicable, the Department will provide a map for each state highway within 30 feet, together with the names and addresses of landowners on the same property. 10. The location and extent of any federal lands within 30 feet of the proposed easement.
