The information submitted in the Caregiver Declaration must have been furnished to an entity authorized to collect and remit the tax for the care of qualifying children, that is an entity that was required to make the filing before it can become the tax authority, and that is the entity which will process the tax return if the care-giver is the (payer) of the tax. The provider must be able to provide the data to HHS. Each return filed under this tax code must include the information specified by law. If a filing statement is submitted under this tax code as a separate return, the information requested shall be provided for all children for which the filing statement was made, the filing statement must be filed with or attached to the return.
