1. What is the Help Act of 2010? The Help Haiti Act of 2010, or HAIR, was passed by Congress on October 30, 2010 (H. Res. 419). The Act's goals were to speed up the process for Haitian arrivals and citizens to apply for permanent residence or citizenship for individuals in Haiti who were inadmissible. These goals include providing immediate humanitarian access to the most vulnerable Haitians, and facilitating the Government's efforts to promote the Rule of Law and the security, stability and prosperity of Haiti. As set forth below, the following procedures will apply to all new applications for adjustment of status (TRS) filed after October 6, 2010, that are filed with USCIS in Puerto Rico and approved by the Department of Homeland Security (DHS) Regional Operations Center (ROC). For procedures on processing TRS applications filed under the previous TOSS provisions that have already been processed, see the “Applying for Adjustment of Status” section in this PM. 2. What documents are required for Haitian arrivals? An individual requesting to immigrate to the United States must possess one of the following: an original birth certificate, or an attestation on the appropriate document from the Haitian consular section; a document with the following characteristics indicating that the person's parents were born in Haiti: a) a birth certificate issued by a Haitian authority; b) a document signed by the parents stating that their parents were born in Haiti; c) a document evidencing two or more generations of parents who were born in Haiti; or d) a document validating an address in Wait a. The document must include a number that uniquely identifies the individual and their birthplace; or, if the individual is not in Haiti, it must have been generated by the Consulate in that country.
