(a) Prohibition.--None of the funds provided in this Act or provided by any other Act may be made available for planning, research, or development by the Department of Energy of a nuclear weapon system other than a single, full-sized intercontinental ballistic missile (ICBM) until the Secretary of Defense certifies to the congressional defense committees that the Secretary has-- (1) assessed the threat posed by nuclear weapons in any region of the globe and proposed an effective program for-- (A) countering such threats; (B) securing nuclear weapons from the highest terrorist or criminal elements; (C) deterring potential nuclear adversaries; and (D) developing a range of options for countering nuclear terrorism and advancing nuclear nonproliferation and nuclear defense policy; and (2) completed a comprehensive assessment on the feasibility and advisability of establishing a national stockpile stewardship program that addresses-- (A) the risk of nuclear weapon terrorism and the consequences of failing to establish such a program; and (B) the risks to national security, including the cost and other impacts of an accident or incident involving such a program. (b) Report.--Not later than January 1, 2012, the Secretary of Defense shall submit to the congressional defense committees a report on whether a national stockpile stewardship program is needed to address-- (1) the risk of nuclear weapon terror, the consequences of failing to establish such a program, or the risks to national security of inadequate security arrangements for nuclear material in the United States; and (2) the potential for preventing an accident or incident involving a nuclear weapon or a nuclear weapon component.
