If a nonresident (and their immediate and extended family members) were to reside primarily in Alabama in a taxable year, they must be treated as residents (in the sense of using the general definitions of residents as set forth in Alabama Rev. Stat. Ann. §1-3.01 et seq.) for reporting and payment of tax. If a nonresident owned/leased property in Alabama in the taxable year, the entity will receive Form PTE–C issued to the nonresident owner/s of the property in the taxable year by the Alabama Department of Revenue (as outlined below), and Form PTE-CK1 issued to the nonresident owner/s of the property in the taxable year. The nonresident's address shall be the address of an address in Alabama. The nonresident's Alabama address must be the address of a state or federal recognized address used by the nonresident. The nonresident will have to complete Form PTE-C, Schedule PTE-CK1, and submit to the Alabama Department of Revenue a copy of the return on or before April 15th (the filing deadline) of each year of the nonresident owner/shareholder's taxable year, and/or a copy of Form PTE–C, Schedule PTE-CK1, and Form PTE-CK1 for each year from which the nonresident was absent during the taxable year. Additional instructions will be provided to taxpayers and taxpayers will be mailed Form PTE-C, Schedule PTE-CK1, and Form PTE-CK1, and instructions, before the April 15th deadline. Payment for tax withheld shall be processed on or before April 15th of the year after the year in which the owner/s of the property is paid. A copy of the return on or before Form PTE-C, Form PTE-CK1, should be mailed to the nonresident owner/s on or before April 15th. Filing Deadlines. Form PTE-C and Schedule PTE-CK1 may be filed on or before April 15th of the years of inclusion (first and second or subsequent taxable years).
