“ Taxpayers with a large IRA (over 117,000) must provide a non-response to the IRA deduction question on the Form 1040 and Form 1040A, though they should continue answering income questions on other forms if so requested. However, under IRC § 6662 (4), a taxpayer must give the IRS a completed Form W-2 (or Form 1099-R) each time the value of the IRA is increased, changed, or withdrawn. The maximum contribution for a traditional IRA is just under 25,000 for a person age 50 or older, though some may contribute up to 50,000 (with the balance restricted to be used for medical expenses only). (See IRM 21.5.6.6.14.) A traditional IRA may hold an amount in the form of traditional pre-tax income without being taxed (a tax-deferred distribution), while the Roth IRA (a tax-free distribution) is taxed on distribution. A traditional IRA can hold no more than the amount of IRA owner's income subject to taxes during a year. IRC § 408(k)(2) defines non-taxable distributions as any distributions not required to be distributed under IRC § 408(a)(1)(A) by the taxpayer due to death, divorce, legal separation, or abandonment of the taxpayer's IRA. Non-taxable distributions are not considered excess contributions in IRC § 408(p)(1). A tax-free distribution is any distribution, other than a Roth distribution, made to a decedent for the amount of the amount of traditional IRA owner's retirement income subject to a 4% excise tax without regard to any previous distributions made before the effective date of a conversion that has resulted in the taxpayer having a distribution. If the IRA owner was under age 50 1/2 when she or he converted the IRA to a Roth, all non-taxable distributions are tax-free unless the taxpayer was under age 59 ½ at the time the conversion occurred. In that situation, the amounts in a Roth distribution must be distributed without a 10% early distribution penalty (unless the conversion was also a Roth conversion for the same period of time).
