The Department of Consumer Affairs prohibits the establishment of illegal pushcart vending operations. The department adopts rules to regulate pushcart vending. These rules apply to all persons providing services on the public streets under the auspices of pushcart vendors.
Note: The Department of Consumer Affairs sets forth the regulations for pushcart vending on pages 27-28 of the California Administrative Code.

SEC. 5.38.010 Purpose and scope.
The purpose of this Article and the scope of this Chapter is to regulate and control the licensing, operation and operation of pushcart vending, to provide for regulations regarding the operation and operation of pushcart vending devices, to provide for certain regulations and administrative requirements, such as an insurance policy, and to provide for requirements related to a temporary transfer of a pushcart vendor permit.

SEC. 5.38.020 Definitions.
For the purpose of this Chapter:
(a) “Licensed” means the classification given to any person by another state or nation which makes the person a licensed person pursuant to the laws of the state in which the person is located.
(b) “Operate” means operate pursuant to this Chapter or the rules adopted under this Chapter.

SEC. 5.38.030 “Pushcart Vendor” defined.
The term “pushcart vending” means the purchase of, and distribution of, items from retail sellers for use for the benefit of a patient at a medical facility or any other facility in which he or she is required to be under his or her care in order to perform any of his or her duties.
