What is the ESIGN Act?

The Electronic Signature in Global and National Commerce Act (ESIGN Act) is a United States federal law legalizing the use of electronic records and signatures for any situation of commerce. The ESIGN Act allows for the use of electronic records to satisfy any statute, regulation or rule of law requiring that such information be provided in writing, assuming the consumer has affirmatively consented to such use and has not withdrawn such consent.
