Field Sobriety Tests: What Police Don't Want You To Know. In most cases when a motorist has been detained for a traffic violation and is suspected of drunk driving, the investigating officer will request the suspect to perform certain field sobriety tests (Fits). It is impossible to pass a field sobriety test.
When police officers arrest anyone, they believe they have probable cause to do so. If an individual passes the field sobriety tests, and does not register as legally intoxicated on a roadside breathalyzer test, the officer can still arrest the person if the officer suspects they are a danger to others.
In California, if you have been pulled over but not arrested, you can refuse a chemical test. However, if you refuse to take a field sobriety test when you've been pulled over under suspicion of driving under the influence (DUI), you may inadvertently give a police officer grounds to arrest you.
Refusing field sobriety tests will most likely result in the person being arrested. If an individual passes the field sobriety tests, and does not register as legally intoxicated on a roadside breathalyzer test, the officer can still arrest the person if the officer suspects they are a danger to others.
Pretest. The subject should be asked to remove their glasses. Instructions. Positioning the Stimulus. Passes -- General. Passes -- Equal Tracking. Passes -- Smooth Pursuit. Passes -- Maximum Deviation. Passes -- Onset Angle of Nystagmus.
There are a total of three clues that can be assessed in this test: lack of smooth pursuit, distinct nystagmus at maximum deviation, and the onset of nystagmus prior to 45 degrees. Each eye is scored independently for three clues in each eye giving a total of six indicators/cues.
In the horizontal gaze nystagmus test used by law enforcement officials, the officer positions an object, usually a pen or a finger, about one foot from the driver's face and then moves the object from one side to another while observing the driver's eye movements.
NHTSA analyzed the laboratory test data and found: HAN, by itself, was 77% accurate. WAT, by itself, was 68% accurate. OLD, by itself, was 65% accurate.
Use of Field Sobriety Tests They have published several training manuals associated with Fits. As a result of the NHTSA studies, the walk-and-turn test was determined to be 68% accurate, and the one-leg stand test is only 65% accurate when administered to people within the study parameters.
