If you are terminated, you want to be able to negotiate a reasonable severance package, especially if you have an existing employment agreement. And your ability to get additional severance pay or benefits will depend on any negotiating leverage and potential claims against the company you may have.
The severance pay offered is typically one to two weeks for every year worked but can be more. If the job loss create an economic hardship, discuss this with your (former) employer. The general practice is to try to get four weeks of severance pay for each year worked.
There is no legal requirement under California law that employers provide severance pay to an employee upon termination of employment. Employees should refer to their employer's policy with respect to severance pay. In certain limited situations, California laws may apply.
Some employers choose to offer severance pay to employees who are terminated, either involuntarily or voluntarily. The primary reasons for offering a severance package are to soften the blow of an involuntary termination and to avoid future lawsuits by having the employee sign a release in exchange for the severance.
Because severance packages are generally not required by law, employers typically set the terms. So, if you ask for changes or make a counteroffer, that could be considered rejecting the package, and the offer may be withdrawn entirely.
Realize you don't have to take your company's first offer. The amount of severance your employer offers initially is not necessarily the amount you need to agree to. Take your time responding. Keep things professional. Fight for benefits as well as money. Don't limit your job prospects.
For example, receiving severance pay does not impact your benefits in California, even if you receive it in a lump sum instead of in regular installments like a paycheck. You might be eligible to claim unemployment benefits if your weekly severance pay is less than the maximum weekly unemployment insurance rate.
You can choose how to pay the severance compensation. A lump sum is the full amount of severance pay given upfront. The large amount might be difficult for your business to pay out at once. But with a lump sum payment, the former employee is more likely to qualify for unemployment compensation in following weeks.
Dealer explains, In most circumstances, an individual receiving severance pay is disqualified from receiving unemployment benefits during the period of severance. However, in Massachusetts, an employee who signs a release of claims is able to file for unemployment upon separation.
Although you don't have to sign a severance agreement, your employer may make it a condition of receiving severance pay. However, in most cases, an employer is free to condition severance on the employee signing the agreement. In other words, if the employee refuses to sign, the employee won't get any severance pay.
If your severance agreement included a release, you may have given up the right to sue your former employer. Some employers offer severance to employees who lose their jobs. Often, however, employees who want a severance package have to sign a release or waiver, by which they give up their right to sue the company.
When you receive severance pay as your employer terminates you, the Connecticut Department of Labor (CT DOL) doesn't automatically disqualify you from unemployment benefits. However, if you conceal your severance pay, so you can collect more unemployment, you'll face stiff penalties from the Connecticut government.
Accordingly, you would divide your yearly salary by 52 to get the weekly pay rate. Then, multiply this pay rate by the number of weeks. If you earn $39,000 a year, then you make $750 a week. If you worked for the company for 10 years, then you would get $7,500 in severance.
