Can a statement of truth be signed electronically?
Electronic data constituting a document may be signed by means of other data logically associated with it. In the case of PCOL the document to be signed is the Statement of Truth verifying the Claim Form and the Particulars of Claim.
Can a company sign electronically?
In that case, a deed can be in electronic form and signed electronically by an individual (including an individual attorney signing for a company). A company cannot validly execute a document electronically under s127 of the Corporations Act 2001 (Cth) (Corporations Act).
Do stock transfer forms need to be stamped?

Can written resolutions be signed in counterpart?
A written resolution may be signed in counterpart and will only require the requisite majority to sign for it to be valid, i.e. a simple majority is needed for an ordinary resolution or a three quarters majority is needed for special resolutions.
Does a written resolution need to be signed by all directors?
Written resolutions give the directors greater flexibility in making decisions, as the directors don't have to be present at a board meeting. Directors' decisions made by written resolution must be unanimous. All eligible directors must either sign copies of the written resolution, or otherwise agree to it in writing.
Is a typed signature legally binding?
Does typed signature count? No. There are a number of e-signature laws across the world, such as ESIGN and UETA, which define what constitute a legally binding esignature. Simply typing your name into a document cannot tie the signature to the document.
Does signature have to match legal name?
No, you do not have to use your legal name as your signature. That is your choice. At the same time, your bank and your employer do not have to accept your "custom" signature if they do not want to. That is their choice.
Can anyone witness a signature?
Generally, the person you choose to witness a document should have no financial or other interest in an agreement. A neutral third party is someone not related to either party and who does not benefit from the document. A witness does not have to read the document but they must be present when it is signed.
Can my girlfriend witness my signature?
A party to a deed cannot be a witness to another signature to that deed. Legislation does not prohibit a signatory's spouse, co-habitee or civil partner from acting as a witness and it is also generally acceptable for an employee of a party to witness that party's signature.
