Below is a list of the most common customer questions. If you can’t find an answer to your question, please don’t hesitate to reach out to us.
An Independent Contractor Agreement is a written contract between two parties for a specific service or project. One person or company is hiring another to help on a short term task. Unlike an employment agreement, this document clearly spells out why the party being hired is not an employee for legal and tax purposes.
For most types of projects you hire an independent contractor (IC) to do, the law does not require you to put anything in writing. You can meet with the IC, agree on the terms of your arrangement, and have an oral contract or agreement that is legally binding. Just because you can don't mean you should, however.
United States, 353 F. 2d 216, 218 (1965). Plainly, such a contract does not by itself mean the worker is really an independent contractor, but the lack of a written contract will make employee status much more likely. Furthermore, your client may even have a dispute with the worker directly.

Document #1 — W-9 Form You must have a W-9 on file for each independent contractor so that you don't have to withhold income taxes from that individual. Then, you have the information to create a 1099-MISC form for that person for the tax year (similar to a W-2 form for employees).
Check your work. Before you start the 1099 process, make sure you have all the correct information on your contractors and vendors. Get your 1099s. Fill out the forms. Send out the forms. 5. Mail form 1096 to the IRS. Keep a record of your filing.
First, keep in mind that the “general rule" is that business owners must issue a Form 1099-MISC to each person to whom you have paid at least $600 in rents, services (including parts and materials), prizes and awards or other income payments. You don't need to issue 1099s for payment made for personal purposes.
What is a 1099 Employee? A 1099 employee is one that doesn't fall under normal employment classification rules. Independent contractors are 1099 employees. Instead of having a permanent worker that takes direction from the company, your business would use an independent contractor who works under their own guidance.
If you are self-employed and an independent contractor, your compensation is reported on Form 1099-MISC (along with rents, royalties, and other types of income).
If you're an independent contractor, you'll generally file an IRS Schedule C or C-EZ with your tax return. But unlike many small businesses, you may also receive Form 1099-MISC from companies you do business with, helping you report some or all of your income to the IRS.
Check the year on the tax forms. The IRS changes these forms every year, so make sure you have the current year's version. Make sure you have a Form W-9 for each payee. Order 1099-MISC forms and use the correct form. Check for errors before you submit to the IRS.
Step 1: Gather All Your Income Information. Step 2: Collect All Your Deduction Information. Step 3: Choose A Filing Method. Step 4: File!
