Under the eIDAS Regulation (EU) No 910/2014, a qualified certificate for electronic signature refers to a certificate for electronic signatures, that is issued by a qualified trust service provider and meets the requirements specified within the regulation.
According to eIDAs a QTSP is a trust service provider who provides one or more qualified trust services and is granted the qualified status by the supervisory body (article 3.20). Once the status gained, the TSP is audited every two years to ensure that it still follows Midas strict requirements.
Midas (Electronic Identification, Authentication and Trust Services) is an EU regulation on electronic identification and trust services for electronic transactions in the European Single Market.
Anyone could type a name on a form for it to be legally binding there must be a way to prove the typed name belongs to the person it represents. Simply typing your name into a document cannot tie the signature to the document.
One of the most commonly used electronic signatures today is the Text Typed signature; meaning that one has used a keyboard to type their name, with the intent to sign something. Although Text Typed is the most common, electronic signatures are not limited to this method.
Both UETA and ESIGN grant electronic signatures the same legal status as traditional wet ink signatures in the U.S. These acts: Establish that any law with a signature requirement can be satisfied by an electronic signature. Allow electronically executed agreements to be presented as evidence in court.
The U.S. Code defines an electronic signature for the purpose of US law as “an electronic sound, symbol, or process, attached to or logically associated with a contract or other record and executed or adopted by a person with the intent to sign the record.”
