In general, a contract does not need to be notarized or witnessed to be binding. But for most contracts, we do not generally require them to be witnessed or notarized, to be “legal." The notary removes the issue as to the identity of the parties signing the contract.
A lease can be written or verbal, but a verbal lease can be very difficult to enforce. If you decide to write your own lease make sure you include a clause that states if any condition is not legal, that the rest of the lease is still in effect.

To start with, you'll need to have a business financial statement: a balance sheet and income statement. Many landlords also require a personal financial statement for all owners of the business. You may need some additional guarantees that you will be able to make the lease payments.
In many jurisdictions, if your lease is not properly witnessed it may not be enforceable. In Florida, the general rule is that a commercial lease for a term of more than one year must be signed in the presence of two subscribing witnesses. One exception to that rule involves a corporation leasing property it owns.
Broadly speaking, the lease will be enforceable against the party or parties who signed the lease, even if others did not. It may also provide that it is not valid unless countersigned by the landlord, meaning that even after the tenants sign the landlord may be able to reject the lease.
If there is no tenancy agreement therefore, then there is no authority for the landlord to make any deductions from the tenancy deposit no matter how dreadful the condition of the property when the tenant moves out. If he tries to make any deductions, any challenge made by the tenant will succeed at adjudication.
Of course, most landlords prefer that commercial tenants sign long-term leases (5, 10 years or longer). However, in return, you should ask for certain items in relation to the length of the lease, such as free rent for a period of time and/or a tenant fit-up at the landlord's expense.
Usually between 3 and 5 years in length, standard term leases are a compromise in flexibility and predictability between their short and long-term counterparts. However, unlike the narrow scope of negotiated lease terms in shorter contracts, tenants that elect standard leases at least have some perks available to them.
Step 10 Write the Commercial Lease Agreement Use an attorney or draft the lease yourself. Make sure to gather all the information about the property and the tenant and enter into the agreement. Once completed, the document should be signed with the tenant and landlord in the presence of a notary public.
