Always accept a resignation with dignity and a positive tone, no matter what the circumstances. If you regret the loss of the employee, but have a positive feeling about the arrangement, allow the letter to express your sincere regret. Otherwise, omit any personal statements.
The short answer is that most of the time, no letter of resignation is necessary. Many people do believe that as an employee you need to formally resign from a job by writing a formal resignation letter to your current employer. However, at most companies, there's no formal requirement that you do so.
It is a common misconception that an employee's notice of resignation is not valid unless it has been “accepted" by the employer. The position at common law is that a notice, once validly given, is effective and can neither be “refused" by the employer or "withdrawn" by the employee, without the other's agreement.
An employer can't refuse to accept someone's resignation, and they must follow certain procedures. When a member of staff resigns you must: get them to confirm their resignation in writing. Tell them what their notice period is.
In general, an employee does not have the right to unilaterally withdraw his/her resignation once given. However, it appears clear from case law over the years that an employee may withdraw a notice of resignation where special circumstances exist relating to the context in which the decision to resign was taken.
Be a good listener. Control your reaction. Minimize disruption to the team. Make sure your message to the team is consistent. Praise the former employee. Stay in touch. Attempt to negotiate (if necessary) Reevaluate your risk management plan.
In a resignation letter, when it is stated that the resignation is effective on a specific date, does that date represent the last day of employment, the start of the two-week notice, or the first day on the new job?
The only case when resignation date is the last working day is when you resign with effect from the next day, and your manager/supervisor lets you go without serving the notice period.
When you resign from a position, the normal practice is to give two weeks' notice to your employer. Once you decide to leave without notice, use this resignation letter example to inform your employer that you need to resign immediately, and will not be able to give two weeks' notice.
Tell your manager your reasons for leaving and that you have accepted another position. Give them your resignation letter and thank them for the time they have worked with you.
