It is often seen people copying logos and designs online or from other brands, however, when you copy a logo, you are plagiarizing someone else's work. You will be penalized for plagiarism. It could become a legal offense if the other person uses it against you since you violated the copyrighted logo.
Plagiarism happens when you copy major elements of a logo design without changing how they visually interact. Copying makes your business come across as a watered-down version of another brand. And when you present yourself as an imitator, consumers will assume your business offers less quality and innovation.
In short though, if a logo would qualify for copyright protection as a piece of artwork separate from its use as a corporate identifier, it is copyright protected. Nothing in the law makes the two rights mutually exclusive so many logos can and are enforced using both trademark and copyright.
What is a copyright? When you design a logo, you want to protect your logo from someone else using it. Logo owners can seek copyright protection for their design, which prohibits another company or an individual from reproducing part or all of your logo without your permission.
To search the USPTO's trademark database, go to TESS and choose a search option. If you are searching for a name, you can use the trademark name search. If you are searching a design mark, such as a logo, you will first need to look up your design code using the USPTO's Design Search Code Manual.
Use the Magic wand tool and click the logo, then press and hold shift and click any other parts of the logo that are not selected. You have now selected the image. CTRL + C to copy, open a new document or new layer and CTRL + V to paste. You can turn it into a mask, which is less messy than using the magic wand tool.
Federal Trademark Database You can go to the website of the United States Patent and Trademark Office and use the Trademark Electronic Search System to determine if there is an existing registered logo that is identical to, or confusingly similar to, the logo you would like to use.
The simple answer: Logos are not copyrighted, they are actually trademarked. Whether legal action is taken for replicating a trademarked logo is fully up to the company or entity that owns the trademark. A company still has legal rights to their logo even if it's not trademarked.
