Most of the time it is legal to reduce an employee's pay, but there are some instances in which it isn't. Surprise A surprise pay cut is illegal. Retroactive Employers also don't have the right to tell employees that their pay rate is changing and that the rate is retroactive some number of days.
Retroactive or back pay refers to income owed to an employee from a previous pay period. Retroactive pay may happen for a number of reasons, such as incorrect salary compensation or wages for hours worked, or a pay increase.
Calculating retroactive pay for hourly employees You'll need to know the new hourly rate, the old hourly rate, the effective date for the new hourly rate and the number of hours paid at the old rate. To arrive at the gross retro wages, multiply the hours paid at the old rate by the difference in the old and new rates.
To figure what you owe in retroactive pay, divide the amount of the raise ($5,000) by the number of days (251) for a per day total of $19.92. Multiply that amount by the number of working days she was paid at the wrong rate (8 days).
Retro and back pay are both considered supplemental pay. Supplemental wages are additional pay you provide to employees. When you withhold federal income tax from supplemental pay, you need to use a percentage or aggregate method. If you give retro or back pay as a standalone payment, use the percentage method.
Understand your payslip and pay deductions. For example, you might see 'Sickness Deduction Kronor Retroactive' — this would mean a deduction was made because you were off sick in the last 2 weeks of the previous pay period.
By law, employers cannot unilaterally cut an employee's pay. No one can force you to take a pay cut, so you could reject such an offer even if your fellow workers accept.
If your hours or pay have been cut, you may still be eligible for partial unemployment compensation. However, most of what you earn will be subtracted from your benefit amount. Unemployment benefits are available to employees who are out of work temporarily, through no fault of their own.
