To file an Affidavit of Support, your spouse must submit Form I-864 to U.S. Citizenship and Immigration Services (USCIS), a Department of Homeland Security (DHS) agency, on your behalf.
Every person immigrating through a family member must submit either a qualifying Form I-864 Affidavit of Support, or a Form I-864W Intending Immigrant's Affidavit of Support Exemption if they are exempt from the Affidavit of Support requirement.
This affidavit is required for most family-based immigrants and some employment-based intending immigrants to show that they have adequate means of financial support and are not likely to become a public charge.
An Affidavit of Support is legally enforceable. The sponsor's financial responsibility usually lasts until the applicant either becomes a U.S. citizen, or can be credited with 40 qualifying quarters of work (usually 10 years) under the Social Security Act.
The following types of intending immigrants do not need to file Form I-864, Affidavit of Support: Any intending immigrant who has earned or can receive credit for 40 qualifying quarters (credits) of work in the United States.
What is an Affidavit of Support? The “Affidavit of Support” is a signed document to accept financial responsibility for a family member who is seeking a green card. It is also known as U.S. Immigration Form I-864.
Instead, you should submit an affidavit of support at the time that your fiancé(e), spouse, or child adjusts status to permanent resident after coming to the United States. If you filed an immigrant visa petition for your relative, you must be the sponsor.
A copy of your individual federal income tax return, including W-2s for the most recent tax year, or a statement and/or evidence describing why you were not required to file. Also include a copy of every Form 1099, schedule, and any other evidence of reported income.
