If a landlord is trying to evict a tenant for not paying rent, the landlord must first give the tenant a three-day notice of nonpayment of rent. The notice should tell the tenant how much rent is owed, and that the tenant has three days to pay it. If the tenant pays within the three days, the tenant can stay.
Eviction. When a tenant doesn't respond to a UP notice and the court grants a default judgment in favor of the landlord or property manager, the tenant must leave within five days or be escorted off the premises by the sheriff.
What Happens After a 3-Day Notice to Pay or Quit? Once the tenant receives the notice, you will have to wait 3 business days. During this time, the tenant has a chance to pay you back. If they do not pay you back or respond to the notice, you can then file for an eviction.

Essentially, this law excludes holidays and weekends from the time that a tenant has to respond to a notice. Tenant Responses to a Three-Day Notice The tenant could pay the rent within three days of receiving the notice. If the tenant chooses this does this, the landlord must not proceed with the eviction. The tenant could move out of the rental unit within three days of receiving the notice.
As soon as a tenant fails to pay rent, a landlord can give the tenant a three-day notice. This notice must inform the tenant that if the tenant does not pay rent within three days of receiving the notice, then the landlord will begin eviction proceedings against the tenant (see Cal. Code of CIV. Pro.
WHAT HAPPENS WHEN YOU GET A 3-DAY EVICTION NOTICE. If the tenant is unable to comply with the notice (either pay rent in full or move out), and the landlord later files an eviction, the tenant can expect to be served a summons and complaint for unlawful detained.
