Backdating is the practice of marking a check, contract, or other legally binding agreement, with a date that is prior to the current date. Backdating is usually not allowed and even can be illegal or fraudulent in some situations.
Perhaps the most common form of backdating is as of dates. Frequently, the beginning of a contract will state it is entered into as of a certain date. Use of the phrase as of should be a red flag that the date is not necessarily the date on which the contract was signed.

The date you sign a legal document depends on your situation and needs. If they sign on different days, the document becomes effective on the day the last signatory signs. You cannot postdate or predate signatures on legal contracts. Occasionally, a contract will specify a date by which it requires signatures.
A contract can come into effect on a different day than the day it was signed. In reality, a contract becomes enforceable on its effective date (i.e. the date that your contract becomes official and binding). In other words, the effective date is when your obligations in the contract begin.
